Africa International Chamber of Commerce & Industry and its affiliates (hereinafter referred to as “AICCI”, “We” or “us”), are committed to providing access to our online and offline services to you as you use www.africacham.org (hereinafter referred to as the “Website”) under specific terms and conditions. The scope of AICCI’s commitment is detailed in these Terms & Conditions.
By submitting information, you agree to AICCI’s use of such information as described herein. AICCI offers this website, including all information, tools, and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies, and notices stated here. By visiting our site and/or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink.
These Terms apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content. Please read these Terms carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by these Terms. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any services. If these Terms are considered an offer, acceptance is expressly limited to these Terms. Any new features or tools which are added to the current store shall also be subject to the Terms.

We reserve the right to update, change or replace any part of these Terms by posting updates and/or changes to our website. It is your responsibility to check this page periodically for changes. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes.

1. ACCESSING THE WEBSITE
AICCI expressly holds its right to reject or cancel access to its website (www.africacham.org) and/or access to the services that it provides, on its own or by a third party, without prior notification, for the users who do not comply with these Terms and/or specific conditions that may be applied, where appropriate.
1.1 GEOGRAPHIC RESTRICTIONS
The owner of the Website is based in Ghana. We make no claims that the Website or any of its content is accessible or appropriate outside of Ghana. Access to the Website may not be legal by certain persons or in certain countries. If you access the Website from outside Ghana, you do so on your initiative and are responsible for compliance with local laws.
To accomplish trade policy goals in accordance with restrictive measures and sanctions imposed by the United Nations (UN) which the European Union (EU) transposes into EU law, and with the Office of Foreign Assets Control (OFAC) of the United States (US) considering that some of our manufacturers are based in the US, or Her Majesty’s Treasury of the United Kingdom, AICCI is unable to conduct import and export, wholesale, retail, or any other commercial activities with individuals, businesses, or organizations which are a target of trade, financial, and economic sanctions, or that appear on a sanctions-related list, or that are established or operating in the countries or territories that are the target of comprehensive embargoes or sanctions or parties on the sanctions-related lists referenced above.

1.3 SHIPPING
We work with different carriers such as USPS, UPS, FedEx, DPD, and DHL to give our customers the best possible shipping experience. Shipping rates are calculated by different carriers and displayed during order checkout. These rates are determined by the order fulfillment location, shipping destination, shipping method, and carrier pricing.
1.3.1 CLOTHING & ACCESSORIES
AICCI’s Clothing & Accessories product lines are manufactured in the EU, the US, and Canada, and are available to customers worldwide.
1.4 INTERNATIONAL IMPORT TAXES AND DUTY FEES
Countries outside the USA are subject to customs and import fees and thresholds. For this reason, our products are bound to be taxed according to each country’s specifications. The information provided on our website considers publicly available information on Tax & Duty requirements per country and is subject to change without notice.
2. INFORMATION THAT WE PROVIDE, UPDATES, AND MODIFICATIONS
AICCI makes the most effort and takes all the measures for the online experience of our customers, the visitor, or the user of our Website to be satisfying, but in no case guarantees the proper functioning of the website. AICCI is not responsible if the information made available on this site is not accurate, complete, or current. The material on this site is provided for general information only and should not be relied upon or used as the sole basis for making decisions without consulting primary, more accurate, more complete, or more timely sources of information. Any reliance on the material on this site is at your own risk. This site may contain certain historical information. Historical information, necessarily, is not current and is provided for your reference only.
AICCI reserves the right to modify the contents of this site at any time but has no obligation to update any information on our site. You agree that it is your responsibility to monitor changes to our site. AICCI can, without prior notice; update, revise, or delete the content of its website at any time. This right also includes any features of the website, including the access form, data collection ways, the usage of landing pages, and interaction with social media or advertising, without assuming any responsibility for it. Occasionally there may be information on our site or in the Service that contains typographical errors, inaccuracies, or omissions that may relate to product descriptions, pricing, promotions, offers, product shipping charges, transit times, and availability.

2.1 MODIFICATIONS TO THE TERMS, SERVICE, AND PRICES
Prices for our products are subject to change without notice. We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time. We shall not be liable to you or to any third party for any modification, price change, suspension, or discontinuance of the Service. We reserve the right, at our sole discretion, to update, change or replace any part of these Terms by posting updates and changes to our website. It is your responsibility to check our website periodically for changes. 2.2 PRODUCTS OR SERVICES (IF APPLICABLE)
Certain products or services may be available exclusively online through the website. These products or services may have limited quantities and are subject to return or exchange only according to our Returns & Replacement Policy stated below in Clause 9. We have made every effort to display as accurately as possible the colors and images of our products that appear at the store. We cannot guarantee that your computer monitor’s display of any color will be accurate. We reserve the right but are not obligated to limit the sales of our products or Services to any person, geographic region, or jurisdiction.
We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or services that we offer. All descriptions of products or product pricing are subject to change at any time without notice, at our sole discretion. We reserve the right to discontinue any product at any time. Any offer for any product or service made on this site is void where prohibited. We do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected.
2.3 ACCURACY OF BILLING AND ACCOUNT INFORMATION
We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household, or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e‑mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers, or distributors. You agree to provide current, complete, and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers, and expiration dates, so that we can complete your transactions and contact you as needed. 2.4 OPTIONAL TOOLS
We may provide you with access to third-party tools over which we neither monitor nor have any control or input. You acknowledge and agree that we provide access to such tools ”as is” and “as available” without any warranties, representations, or conditions of any kind and without any endorsement. We shall have no liability whatsoever arising from or relating to your use of optional third-party tools. Any use by you of optional tools offered through the site is entirely at your own risk and discretion and you should ensure that you are familiar with and approve of the terms on which tools are provided by the relevant third-party provider(s). We may also, in the future, offer new services and/or features through the website (including, the release of new tools and resources). 3. INTELLECTUAL PROPERTY RIGHTS AND POLICY
We expect the users of our website to respect our intellectual property rights. AICCI holds the intellectual property rights of its website, its design, its branding and logos, its navigation structure, and the possible various elements that constitute its corporate image. It corresponds also to the exclusive exercise of the rights of exploitation of the same in any form and, especially, the rights of reproduction, distribution, public communication, and transformation.
AICCI inherently holds its intellectual property rights of all contents, information, and elements regarding the AICCI brand that the customer, the visitor, and the user can access through the Website (www.africacham.org).
All other trademarks are the property of their respective owners. Accessing the content or elements of the website, will not give the user the right, in any case, to modify, reproduce, distribute, exploit, or communicate to the public for the content or elements provided by the Website, or services of any third party, or grant any other right which affects the right holder.
Unless you do have prior and clear authorization in writing of AICCI, it is definitely forbidden to modify, copy, reuse, exploit, reproduce, communicate publicly, transmit, or distribute in any way some parts or all of the content of the Web for commercial or public purposes.
The users or the visitors can use our content information by specifying a link to our site, or by specifying the source as the Website www.africacham.org, or can share the posts through a link to the Website. But, without clear authorization of AICCI and without the reference made to the source of origin as the Website, it is not allowed to copy and paste the Website’s content on other websites or blogs.
4. LANGUAGE
In AICCI, we are doing business in different languages. The user will be choosing his preferred language when accessing the Website and all information on the Website will be displayed in the language chosen by the user. The language that we communicate with our customers, the user of the Website, and the completion of the web forms will be in the chosen language or in English, by default.
5. TERMS TO USE THE WEBSITE
We are informing you about the conditions that should be exclusively fulfilled if you -as the user- would like to partially visualize, print, or download the content of the Website.
The purpose or way of use should be compatible with the purposes of the Website.
You can obtain data or information only for private and personal use. In any case, it cannot be used in social media, other website or services, or the press. If you don’t have the prior written authorization of AICCI, it is strictly prohibited to use it publicly for commercial purposes, transmission, or communication.
The text or the images that accompany the graphics, icons, or images are inseparable parts. Thus, the graphics, icons, or images of the Website, cannot be used, copied, or distributed separately from the text or the rest of the images that accompany them. (d) to infringe upon or violate our intellectual property rights or the intellectual property rights of others;
(e) to harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate based on gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability; (f) to submit false or misleading information;
(g) to upload or transmit viruses or any other type of malicious code that will or may be used in any way that will affect the functionality or operation of the Service or of any related website, other websites, or the Internet;

In no case shall AICCI, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the Service or any products procured using the Service, or for any other claim related in any way to your use of the Service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the Service or any content (or product) posted, transmitted, or otherwise made available via the Service, even if advised of their possibility. 6.1 ACCESSING THE WEBSITE OR ITS CONTENT
AICCI puts continuous effort so that the users or the visitors can access the Website correctly, and does its best to keep the Website up to date, but it does not guarantee the absence of errors or interruptions while accessing the website or its content, nor its updates. AICCI does its best at aiming to correct problems as soon as it is aware of errors, connection problems, or lack of content updates. But, it is only possible when the causes do not depend on AICCI, the Website, or the server, nor on causes that would make it difficult or impossible to implement.
The access to the Website and the unconsidered use that may be made of the information contained therein is the exclusive responsibility of the person who performs it. For the consequences or damages arising from this kind of use or access, AICCI cannot be held responsible. But, AICCI may initiate the appropriate procedures against the user, through the available legal remedies, and demand compensation for damages that may occur to the brand, the Website, or to AICCI.
6.2 THE USER’S COMPUTER SYSTEM AND SECURITY ERRORS
AICCI does its best and takes all the necessary measures for virus protection and technical security, but does not guarantee that any content, data, computer system, or similar materials are free of viruses or other harmful components. Thus, AICCI cannot be held responsible for security errors that may occur or for any damage that may be caused to the user’s computer system (hardware and software), or the files or documents stored. These damages can be the results of a malfunction or non-updated version of the browser or the existence of a virus in the user’s computer that is used for the connection to the services and contents of the website.
6.3 THIRD PARTIES, EXTERNAL LINKS, AND LINKED CONTENT
AICCI’s Website may contain links to webpages or websites of third parties related to its business or aims. This kind of link would take the user out of our website. Certain content, products, and services available via our Service may include materials from third parties. Third-party links on this site may direct you to third-party websites that are not affiliated with us.
We are not responsible for examining or evaluating the content or accuracy and we do not warrant and will not have any liability or responsibility for any third-party materials or websites, or for any other materials, products, or services of third parties.
We are not liable for any harm or damages related to the purchase or use of goods, services, resources, content, or any other transactions made in connection with any third-party websites. Complaints, claims, concerns, or questions regarding third-party products should be directed to the third party.
AICCI holds no responsibility for contents linked from its website or any other services that we offer through it unless they are related to it, nor ensures the nonexistence of viruses or other elements that may cause problems in hardware, software, documents, or files of the user, excluding any liability for damages of any kind caused to the user for this reason.
AICCI should be contacted via email at info@africacham.org if any user, client, or third party considers that the content or services provided on the website or linked pages are considered to be illegal, or injure the property or rights of the user itself, a customer, or a third party liable for compensation. In particular, if they are:
- Contents, services, or activities that the Ghanan Criminal Laws and regulations may consider criminal.
- Contents or activities that may put in danger the public order or security, criminal investigation, and/or national defense.
- Contents or activities violating intellectual or industrial property rights.
- Contents or activities that endanger public health, respect for the dignity of a person, the principle of non-discrimination, and the protection of health and childhood.
7. USER’S LIABILITY AND RESPONSIBILITY
The user of the website agrees to comply with these Terms, also with the instructions or warnings mentioned therein or through our website. The user also agrees to always act in accordance with the law, customs, and requirements of good faith, using the appropriate diligence to the nature of the service that he/she enjoys. Actions or ways of using the Website that may damage the normal functioning of the Website, the products, or the rights of AICCI, the rest of the users, or any third party, in general, should be avoided. As the user, you are, specifically, without implying any restriction to the obligation assumed in general in accordance with the previous section, obliged in the use of the Website and in the completion of the existing forms in it to the below-mentioned:
- You should provide your data truthfully and accurately, and keep it up-to-date. You should not use false identities or impersonate others on the Website.
- You should not enter, store, spread on, or from our Website, any information or material that is threatening, slanderous, obscene, incites violence, xenophobia, discriminates based on race, sex, ideology, religion, or in any way violates the public order, fundamental rights, public liberties, honor, privacy, or image of third parties, and in general current regulations.
You should not enter, store, or spread through our website any computer program, data, virus, code, hardware or telecommunication equipment, instrument, or any other electronic or physical device that is likely to cause damage to the Website in any of the services, or in any of the equipment, systems or networks of AICCI of any user, of the providers of the Website, or of any third party in general, or that in any other way is capable of causing any type of alteration or prevent the normal operation of these.
- Unless you have a prior agreement with AICCI, you should not perform activities such as advertising, commercial or promotional exploitation of or through the Website.
- You should not use the information that you have received through the Website for sending advertising, messages for direct sales, or any other commercial purpose, or to collect or store personal data that belongs to third parties.
- You should not destroy, modify or disable the data, information, programs, or electronic documents that belong to AICCI or any other third parties.
- You should not introduce, store, or spread through the Website any content that infringes and harms intellectual property rights, industrial or business secrets of third parties, or any content which will not hold, in accordance with the law, the right to make it available to third parties.
7.1 USER COMMENTS, FEEDBACK, AND OTHER SUBMISSIONS
If at our request, you send certain specific submissions (for example contest entries) or without a request from us you send creative ideas, suggestions, proposals, plans, or other materials, whether online, by email, by postal mail, or otherwise (collectively, ‘comments’), you agree that we may, at any time, without restriction, edit, copy, publish, distribute, translate and otherwise use in any medium any comments that you forward to us. We are and shall be under no obligation to:
a. Maintain any comments in confidence;
b. Pay compensation for any comments; or
c. Respond to any comments.
We may, but have no obligation to, monitor, edit or remove content that we determine in our sole discretion are unlawful, offensive, threatening, libelous, defamatory, pornographic, obscene, or otherwise objectionable or violates any party’s intellectual property or these Terms. You agree that your comments will not violate any rights of any third party, including copyright, trademark, privacy, personality, or other personal or proprietary rights. You further agree that your comments will not contain libelous or otherwise unlawful, abusive, or obscene material, or contain any computer virus or other malware that could in any way affect the operation of the Service or any related website. You may not use a false e‑mail address, pretend to be someone other than yourself, or otherwise mislead us or third parties as to the origin of any comments. You are solely responsible for any comments you make and their accuracy. We take no responsibility and assume no liability for any comments posted by you or any third party.
8. THE USE OF SOCIAL MEDIA
Our website includes social networks and allows the user to interact through them such as Facebook, Instagram, Twitter, LinkedIn, Pinterest, Reddit, and YouTube, among others. At AICCI, we are using social media to listen to our customers to inform them, help them, and ensure them safe access to our services provided by a professional team. Additionally, these social channels allow users to share their opinions. Therefore, we are aiming to have constructive and respectful communication through social media. For this reason, we are here presenting our rules, in addition to those of our Website, that regulate communication via social networks:
a. Social networks are public platforms; thus, the users should be keeping this in mind while they are interacting on platforms where AICCI appears in. They should not share personal data, information, or visuals that may be used against them.
b. The language to be used in networks must be correct, constructive, and respectful.
c. AICCI reserves its right to eliminate, without right of reply, any contribution that:

- May violate fundamental rights, be slanderous, discriminatory, or be threatening other users or AICCI, or that is illegal.
- Incorporates third-party data without authorization.
- Criticizes or disqualifies other users or AICCI.
Aims to advertise to the user or do private business.
- Is not related to the theme of the channel, the brand, or to AICCI products and/or services.
d. AICCI uses its social network profiles to make contacts, exchange opinions, and create constructive debates. Therefore, these should not be used for other purposes such as claims, exercising ARCO rights (Access, Rectification, Cancellation, and Opposition), or submitting complaints. For all these matters, you may find specific guidance and ways on our website and solve any issue by leaving a message at info@africacham.org. No particular issues or controversies are resolved on social media channels.
e. AICCI is responsible only for what it publishes on social media, in no case third-party publications are its responsibility.
f. The comments and documentation provided by the user in the AICCI social media channels can be used by AICCI. The user will be informed as it will be marked as a favorite or through the form that each network establishes. At any time they can exercise their rights by sending an e-mail to info@africacham.org. The use of these contributions will not generate any pecuniary or material consideration.
g. The user can only share the contents of the website through social media by respecting the Copyright Policy in accordance with the provisions of these Terms of Use.
9. RETURNS & REPLACEMENT POLICY
Our refund and returns policy lasts 30 days. If 30 days have passed since your purchase, we can’t offer you a full refund or exchange. To be eligible for a return, your item must be unused and in the same condition that you received it. It must also be in the original packaging. Any claims for misprinted/damaged/defective items must be submitted within 30 days after the product has been received.
For packages lost in transit, all claims must be submitted no later than 30 days after the estimated delivery date.
Claims deemed an error on our part are covered at our expense and are either replaced or fully refunded.
If you notice an issue with our products or anything in your order that seems to be out of place, contact our customer support team and send a photograph along with a brief explanation of the problem. To complete your return, we require a receipt or proof of purchase. We will review the issue and notify you of the approval or rejection of a replacement/refund. Once your return is received and inspected, we will send you an email to notify you that we have received your returned item. If your claim gets approved, and you require a replacement, we will have a new order shipped to you within 3 business days. In case you request a refund, a credit will be automatically applied to your credit card or original method of payment within a few work days.
9.1 EXEMPTIONS
AICCI will not grant a refund, credit your account, or replace a produced product in case of:
- Wrong Address: If you provide an address that is considered insufficient by the courier, the shipment will be returned to our facility. You will be liable for reshipment costs once we have confirmed an updated address with you (if and as applicable).
- Unclaimed: Shipments that go unclaimed are returned to our facility and you will be liable for the cost of a reshipment to you (if and as applicable).
- Buyer’s remorse: We do not refund orders for buyer’s remorse, only for misprinted, damaged, or defective items.
9.2 LATE OR MISSING REFUNDS
If you haven’t received a refund yet, first check your bank account again. Then contact your credit/debit card company, it may take some time before your refund is officially posted. Next, contact your bank. There is often some processing time before a refund is posted. If you’ve done all of this and you still have not received your refund yet, please contact us at info@africacham.org.
9.3 SALE ITEMS
Only regular-priced items may be refunded. Sale items cannot be refunded.
9.4 EXCHANGES
We only replace items if they are defective or damaged. If you need to exchange it for the same item, send us an email at info@africacham.org and consult the address where the product should be sent, as stated below.
9.5 SHIPPING RETURNS
As our products are manufactured in different parts of the world, it is important to identify the right return address. To return your product, you should inquire about the exact manufacturing address before mailing your product. You will be responsible for paying for your own shipping costs for returning your item. Shipping costs are non-refundable. If you receive a refund, the cost of return shipping will be deducted from your refund. Depending on where you live, the time it may take for your exchanged product to reach you may vary. If you are returning more expensive items, you may consider using a trackable shipping service or purchasing shipping insurance. We don’t guarantee that we will receive your returned item.
10. DURATION AND TERMINATION OF THE TERMS & CONDITIONS
The availability of the services and/or contents of the Website has an indefinite duration. Notwithstanding the foregoing, AICCI can, at any time, without prior notice, unilaterally terminate, suspend or interrupt, the availability of the web service (totally or partially) and/or any of the services, without prejudice to what has been arranged in this respect, in the corresponding particular conditions.
11. INTERNATIONAL TRANSFER OF DATA
Please note that the data that we obtain through the AICCI website will be transferred, processed, and inside the European Economic Area, specifically in our central office in Accra, Ghana. We care about the privacy of our users and therefore we take action to safeguard your information. 12. APPLICABLE AND GOVERNING LAW
The Terms and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of Ghana and remain, for all purposes, subject to Ghanan Courts. AICCI, the visitors of this Website, and any other person using any service provided in it, expressly disclaims any other jurisdiction that may correspond, without prejudice to the competence resulting from the Ministry of the law and the Courts and Tribunals of the City of Tallinn are authorized for the resolution of any question that may arise as a result of the interpretation, application, and fulfillment of these conditions, as well as the claims that may arise from its use.
13. INDEMNIFICATION
You agree to indemnify, defend and hold harmless AICCI and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns, and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of your breach of these Terms or the documents they incorporate by reference or your violation of any law or the rights of a third party.
14. SEVERABILITY
In the event that any provision of these Terms of Service is determined to be unlawful, void, or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms, such determination shall not affect the validity and enforceability of any other remaining provisions.
15. TERMINATION
The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes. These Terms are effective unless and until terminated by either you or us. You may terminate these Terms at any time by notifying us that you no longer wish to use our Services, or when you cease using our site.
